Parliament, the Constitution prevails. Parliament is empowered to amend the Constitution but any changes must be effected in accordance with the provisions of the Constitution.
Dewan Rakyat (House of Representatives)
Members of the Dewan Rakyat are directly elected by the people through general elections. Persons holding office of profit, including public servants, are not eligible for election to the House. They will have to resign before contesting an election.
Currently, there are 193 members of the House of Representatives. The regional breakdown of these members is 144 from peninsular Malaysia, 28 from Sarawak, 20 from Sabah and I from Labuan.
Dewan Negara (Senate)
Dewan Negara consists of 69 elected and appointed members, of which 43 are appointed by the Yang di-Pertuan Agong. Each state has 2 representatives in the Dewan Negara, 2 more from the Federal Territory (FT) of Kuala Lumpur and another from the FT of Labuan.
JUDICIAL AUTHORITY
The Judicial power of the Federation is vested in the Federal Court, Court of Appeal, the High Court Malaya, the High Court Sabah and Sarawak and the
subordinate courts as provided by federal law. The Chief Justice is the head of the judiciary. His appointment, like those of the President of Court of Appeal, the Chief Judges of the two High Courts, judges of the Federal Court, the Court of Appeal and the
High Court, are made by His Majesty the Yang di-Pertuan Agong on the advice of the Prime Minister after consulting the Conference of Rules.
EXECUTIVE AUTHORITY
The Executive Authority is vested in the Yang di-Pertuan Agong and exercisable by a cabinet of ministers, headed by the Prime Minister who in accordance with the principle of a democratic system is the Chief Executive. The Cabinet is collectively responsible to Parliament.
